Constructor character model in commercial projects

Can the constructor (construction worker) character model included with the 3rd person character controller be used in commercial Unity projects? If so, would I possess copyright on a derivative character made using a customized version (modified texture and model)?

I’m almost positive that’s wrong. You can use any Unity asset in any sort of project except for certain specific cases mentioned in the EULA (gambling apps, embedded software, and streaming video services). Commercial or non-commercial makes no difference with any part of Unity or with copyright law in general. And yes you’d own the derivative work in the same way it usually works. If you want to be absolutely sure though, send an email to Unity Support; don’t just take the word of random people on the forums.
