Is everything ok now and wuold it be safe to make the transition to Snow Leopard ?
The upper/lower case thing is not specific to Leopard. It just does a case-insensitive search and finds the file itself, thus preventing the rename. I used Unity with Snow Leopard for a while and had no problems. The only issue I was ever aware of, though, was the 64-bit web player one.
It does seem to be fixed. UT said it was, in bug fix notes, and since then, I only had it happen one time. I can’t explain the one time, but that’s rare enough for me to consider it a non-issue.
