Particle Shader/Tree Billboard Bug?

Hi, I’m sure someone has mentioned this before but I couldn’t figure out how to word it to search for any more information. I have found that the particle render shaders have an issue overlapping my trees when they are billboards. The image below clearly shows the particle emitter is behind the tree. The second image shows that when the tree changes to the billboard it is rendered behind the particle effect. Is there a way to fix this? or will this be fixed in Unity 3?
