I will be fair to admit i wasn’t thinking about that when i created him. Since i created political caricatures, i listened some youtube videos about all that what is going on on political arena in US, and found out about Pepe and Kekistan. So i made him as “mascot” addition to my politicians… But i did found out later this frog actually have a creator… Still i took a chance to publish him do to fact he is internet meme millions of people world wide are using freely without any problems, therefore i saw it as good opportunity… Still, by looking at image you shared, my Pepe is bit different. He also have teeth. And color of his skin can easily be changed in gimp of Photoshop.
Still, if you believe this is copyright violation i would 100% understand if Asset store staff decide to take him down. And i do understand your concerns, especially regarding developers who live in US, where lawsuits are like saying “good day”. On other parts of the world situation regarding that type of things is very very different… As you know all assets go true review by curators before they are allowed to be published. This one was published.
It was just a warning just in case so you are properly informed, the risk is in your hand, previously meme (nyan cat) have been used for commercial project and the creator sued them, they are still created by someone, while it may allow “fair use” like with fan art, it does not necessarily protect you, million people do nintendo fan art, but see how fast the guillotine fall once it cross commercial aspects or threat one of their product (see metroid AM2R).

Alright. I considered all aspects of this situation, and i decided to offer my Pepe for free. I made the change to the pack, and im now awaiting for price update to be published. Also i included warning in description for possible copyright issues, and advice for this character to be used in non commercial projects… Legally, those copyright problems are problems mostly only in US, so my concern is not legality. I would literally be the first in my country to face such legal problems if they would happen. But it is morally, since this thing have creator. I don’t want to be viewed as someone who is creating and using other peoples ideas to earn some money. But, as 3D artist my job is actually to create 3D characters based on 2D concepts of other people. This is essentially job of 3D artists in industry. So i still want to showcase my abilities
