Possible Legal problems?

I was wondering, would it be ilegal if I remake parts of a video clip in Unity for a free WebPlayer including the music?

I would end up puting it in my portfolio.

The only real thing that wouldn’t be mine is the song, but credits to DaftPunk would be in the WebPlayer. And I would be taking the song from a free youtube video that millons can see.

So I’m wondering, would I get in trouble?

First of all, the legality of that video being available on youtube itself is questionable. That poster just seems to be distributing a bootleg video, and the owners of the copyright could get youtube to pull it.

Second, the only way you would be able to use any material from anyone without written consent is under the ‘fair use’ doctrine. Note that the fair use doctrine generally only applies to things such as commentary, parody, criticism, news reporting, research, teaching, library archiving and scholarship. If your project somehow fits that description, you’re probably okay.

You’re claiming that its for a ‘portfolio,’ which could be considered scholarship if you are a student and you’re making this portfolio for some kind of school assignment.

Third is the ‘would I get in trouble if I accidentally (or even intentionally) break copyright’ issue. Well, you have to define ‘trouble.’ A lot of e-lawyers on the internet make it seem like if you screw up, the dogs of hell will be unleashed upon you and your skin peeled off. That probably won’t happen. You’ll likely get a cease and desist order after which point you’ll have to take down your creation.
