tagging for under age of consent

I have added an age gate in my ftp mobile game as I am trying to pitch it to mixed age audience.
I am struggling to understand when to set the under age of consent flag for mediation partners to satisfy COPPA and GDPR.

Is it under 13? Or is it under 16? Or under 18? Or does it depend on georgraphy? and is there a list anywhere out there - I couldn’t find one.

If it does depend on geography, making a valid determination seems impossible without violating GDPR or COPPA.

Or given that age gates are really just an ---- covering exercise anyway, should I just set the flag if they are under 18 and not worry about it.

We understand you have some questions on COPPA and GDPR against LevelPlay mediation, especially for COPPA.

If you would like to apply settings applicable to children with respect to a specific user, as may be required by applicable laws, or if the app is partially, but not primarily, directed to children under COPPA (sometimes called a mixed-audience app), and has implemented an age gate, then you should flag the app as a “Mixed Audience” app in LevelPlay dashboard . In this case, you must use COPPA SDK Functionality to flag whether a specific end-user is a child below the age of 13, 16 or other ages depending on the applicable laws (or another age as applicable to the publisher and app), or not. And you should consult with your legal counsel accordingly.

You are responsible for determining whether an app is primarily directed to children or the app is permitted to use an age gate.

My question is really about knowing when to flag the user as under age of consent. How can I know in advance where the user is from so I can know the age of consent? And what are the ages of consent?

Lets say we put legal counsel to the side, and say I know for certain that for my users from country “A” the legal age of consent is 17. How can I possibly know that my user is from country “A” before I have determined whether I have consent? I need prior knowledge of the age and location to determine if I can ask for consent. To me this seems to be impossible.
